Terms of service
Terms of Service
These Terms of Service govern the use of our online shop and all purchases made through ashford-atelier.com. Please read them carefully before placing an order. By placing an order you agree to these terms.
1. Provider and contract partner
The shop Ashford Atelier is operated by:
Global Ecommerce Solutions Limited, Unit 2A, 17/F Glenealy Tower, 1 Glenealy, Central, Hong Kong. Email: info@ashford-atelier.com
References to "we", "us" and "our" in these terms mean Global Ecommerce Solutions Limited trading as Ashford Atelier.
2. Scope
These terms apply to all orders placed by consumers through our online shop. A consumer is any natural person who enters into the transaction for purposes that are predominantly outside their trade, business or profession.
3. Products and availability
Our product presentations in the online shop do not constitute a binding offer, but an invitation to place an order. All products are offered while stocks last. We take care to describe and display our products accurately, but minor deviations in colour or appearance, for example due to screen settings, do not constitute a defect.
4. Conclusion of the contract
By placing the products in the shopping cart, completing the checkout and clicking the order button, you submit a binding order for the goods in the cart. We will confirm receipt of your order by email immediately after it is sent. This order confirmation does not yet constitute acceptance of your order. A binding contract is concluded when we confirm dispatch of the goods or when we ship the goods to you.
5. Prices
All prices shown in our online shop are final prices and include applicable VAT. Shipping is free of charge, so no additional delivery costs are added at checkout. The total price is shown to you in the order overview before you submit your order.
6. Payment
The following payment methods are available in our shop:
- Credit and debit cards, processed through our payment provider Airwallex
- PayPal
- Clearpay
The payment methods available to you may depend on your order and your country. Payment is due immediately upon conclusion of the contract, unless a payment method with deferred payment, such as Clearpay, has been selected. When paying by Clearpay, the separate terms of Clearpay apply in addition to these terms.
7. Delivery
We deliver across the United Kingdom. Orders are usually processed within 1 to 3 business days. After processing, the expected delivery time is 6 to 10 days. Delivery times are non-binding estimates unless a binding delivery date has been expressly agreed. Further details are set out in our Shipping Policy, which forms part of these terms.
8. Retention of title
The goods remain our property until the purchase price has been paid in full.
9. Right to cancel
As a consumer you have a statutory right to cancel within 14 days under the Consumer Contracts Regulations 2013. In addition, we offer a voluntary return period of 30 days. The conditions, the procedure and the model cancellation form are set out in full in our Return and Refund Policy, which forms part of these terms.
10. Warranty for defects
Your statutory rights under the Consumer Rights Act 2015 apply. If the goods are defective, you are entitled to the statutory remedies. If you discover a defect, please contact us at info@ashford-atelier.com.
11. Limitation of liability
We are liable without limitation for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under applicable law.
Subject to the foregoing, we are not liable for losses that were not foreseeable, for losses not caused by our breach, or for business losses (such as loss of profits, loss of business or loss of opportunity).
This limitation of liability does not affect your statutory rights as a consumer.
12. Dispute resolution
We are not obliged to participate in dispute resolution proceedings before a consumer arbitration body, but we will always try to resolve any complaint with you directly. Please contact us first at info@ashford-atelier.com.
13. Applicable law
These terms and any contract concluded on their basis are governed by the laws of England and Wales. As a consumer, you also retain the protection granted to you by the mandatory provisions of the law of your country of habitual residence.
14. Final provisions
Should any provision of these terms be or become invalid, the validity of the remaining provisions shall not be affected. We reserve the right to amend these terms for future orders. The version in force at the time you place your order applies to that order.
